References to "Suga," "Us", "We" or "Our" means Suga Technology JSC or its subsidiaries, affiliates, parent companies, joint ventures, and other corporate entities under common ownership or control.
By downloading one of our Games, you accept Suga's Terms of Services and our Privacy Policy ("Agreement"). By using or otherwise accessing the Services, you agree to this Agreement. If you do not agree to this Agreement, you may not use or otherwise access the Services.
1. Definitions
1.1 "Account" means an account or profile you create or accept the creation of when you access the Services.
1.2 "Community Rules" means the rules of conduct that govern your interaction with our Services and other players.
1.3 "Services" refers to products, games, services, content, supga.net and/or the other domains provided by Suga.
1.4 "Terms of Service" or "Terms" means these terms of service.
1.5 "User Content" means all the data that you upload or transmit on or through the Service.
1.6 "Virtual Items" means virtual currency, including but not limited to virtual coins, cash, tokens, or points, all for use in the Service, and virtual in-game items.
2. Changes to These Terms
2.1 We reserve the right, at our discretion, to change, modify, add or remove portions of the Terms at any time by posting the amended Terms on our sites or within the Service. Unless We state otherwise, changes are effective when posted. If you continue to use the Services after the changes are posted you agree to the changes.
2.2 If you have a dispute with Suga, the version of the Terms in effect at the time Suga received actual notice of the dispute will apply to such dispute.
3. Account Information and Security
3.1 In order to use our Services, we may ask you to create an Account and select a password and/or provide Us with certain personal information, which may include your name, birth date, e-mail address, and, in some cases, payment information. This information will be held and used in accordance with Suga's Privacy Policy.
3.2 You agree to supply Suga with accurate, complete, and updated information, particularly your email address.
3.3 You are responsible for maintaining the security of your Account. Do not share your Account details with others or allow others to access or use your Account.
3.4 Tell Us immediately of any actual or suspected loss, theft, fraud, or unauthorized use of your Account or Account password.
4. Privacy
4.1 Suga's Privacy Policy tells you how we collect and use information about you and your computer or mobile device. You understand that through your use of our Services, you acknowledge the collection, use, and sharing of this information as described in Suga's Privacy Policy.
5. Using Our Services
5.1 You may not use our Service if you do not agree to Suga's Terms of Service and Privacy Policy, you are under 13 years of age, you have previously been banned from playing any Suga game or using any Service.
5.2 If you are under the age of 18, you represent that your legal guardian has reviewed and agreed to these Terms.
5.3 To access or play our games or create an account with us, you may need an account with a social network, like Facebook, and, if you are using our mobile Service, an account with the company that provides your mobile applications, like an Apple ID or Google Account.
5.4 The Service is evolving and we may require that you accept updates to the Service as well as to the Terms and the Privacy Policy.
5.5 Service Changes and Limitations: Suga reserves the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, either permanently or temporarily, at which point your license to use the Service or any part of it will be automatically terminated or suspended. If that happens, Suga is not required to provide refunds, benefits, or other compensation to players in connection with discontinued elements of the Service.
6. Ownership; Limited License
6.1 The Service is comprised of works owned by Suga, and it is protected by copyright, trademark, trade dress, patent, and other intellectual property and other applicable laws. Suga owns, has licensed, or otherwise has rights to use all of the content that appears in the Service.
6.2 Suga grants you a non-exclusive, non-transferable, revocable limited license to access and use the Service solely for your own non-commercial entertainment purposes.
6.3 You do not own the Account that you create on our Service. Your account and any related items are owned by Suga. Suga gives you a limited license to use your account and the related items while we offer the Services.
6.4 WE MAY DELETE OR TERMINATE ACCOUNTS THAT ARE INACTIVE FOR 360 DAYS.

7. Community Rules
You agree you will not, under any circumstances:
- Use the Service in connection with any violation of any applicable law or regulation
- Post any content that is abusive, threatening, obscene, defamatory, or offensive
- Harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person or group
- Post content that infringes or violates someone else's rights or otherwise violates the law
- Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software
- Try to gain unauthorized access to the Service, accounts registered to others, or to any computer or server
- Collect or harvest other users' content or information
- Use the Service for any unauthorized commercial purpose
- Reverse engineer, decompile, disassemble, or otherwise try to derive the source code from us
8. Payment Terms / In-App Purchases
8.1 In the Service, you may use "real world" money to obtain a limited license to use Virtual Items. You do not legally "own" the Virtual Items and the amounts of any Virtual Item do not refer to any credit balance of real currency or its equivalent.
8.2 ALL SALES ARE FINAL. YOU ACKNOWLEDGE THAT SUGAME IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED.
8.3 If you choose to make a payment for our Services through a third party (like Apple or Google), you acknowledge that all billing and transaction processes are handled by the App Store or Google Play and governed by their terms and conditions.

9. Subscription Terms
9.1 Some of Suga's games may offer subscription services. Your subscription will automatically renew each period unless and until you terminate your subscription or we terminate it. You must cancel Your Subscription in Your Account setting before it renews each period.
9.2 SUBSCRIPTION PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED SUBSCRIPTION PERIODS.
10. Third-Party Advertising
Our Service and our games may feature advertisements from us or other companies. Our Privacy Policy explains what information we share with advertisers. Sometimes we provide links in our games or on the Service to other companies' websites. We make no representation or promises about any content, goods, or services these other companies provide.
11. Warranty Disclaimer
USE OF THE SERVICE IS AT YOUR SOLE RISK. IT IS PROVIDED ON AN "AS IS" BASIS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, SUGAME MAKES NO WARRANTIES, CONDITIONS, OR OTHER TERMS OF ANY KIND, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES.
12. Limitations of Liability
TO THE FULLEST EXTENT ALLOWED BY ANY LAW THAT APPLIES, SUGAME IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING FOR LOSS OF PROFITS, GOODWILL OR DATA, IN ANY WAY WHATSOEVER ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SERVICE.
TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, THE TOTAL LIABILITY OF SUGAME IS LIMITED TO THE TOTAL AMOUNT YOU HAVE PAID SUGAME IN THE ONE HUNDRED AND EIGHTY DAYS (180) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM.
13. Indemnity
If you use or misuse the Service, or if you violate these Terms, and that results in loss or damage or in a claim or liability against Suga, you agree to indemnify, defend and hold harmless Suga for that loss, damage, claim or liability, including compensating Suga for our legal fees or expenses.
14. Applicable Law
These Terms and any dispute or claim arising out of or in connection with their subject matter shall be governed by and construed in accordance with the laws of Vietnam. You agree that the courts of Hanoi, Vietnam shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
15. Force Majeure
We are not liable for any changes or problems out of our control, for example, changes or problems caused by natural disasters, epidemics, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labour or materials.
